Selnotes Copyright and Intellectual Property Policy

At Selnotes, we are committed to fostering a creative and educational environment that empowers students, educators, and independent creators to share and monetize original digital content. At the same time, we place strong emphasis on respecting the rights of intellectual property holders, including publishers, institutions, and individual authors. The following Copyright and Intellectual Property Policy outlines how Selnotes handles copyright matters, including takedown requests, user responsibilities, and dispute resolution procedures.
1. Commitment to Copyright Protection
Selnotes is a platform driven by user-generated content. The materials listed and sold on our site are uploaded independently by our users, not by Selnotes itself. While we provide the infrastructure, we rely on our users to ensure that all uploaded content complies with copyright laws and does not infringe upon the rights of others.
We take intellectual property protection seriously. We do not condone or tolerate the unauthorized use, reproduction, or distribution of copyrighted works on our platform. If valid claims of infringement are made, we take swift action to review and, where appropriate, remove infringing content from the platform in compliance with applicable laws.
2. Takedown Requests by Copyright Holders
If you are a copyright holder, an authorized agent, or a representative of a publisher or organization, and you believe that content hosted on Selnotes infringes your intellectual property rights, you may submit a formal takedown request to our legal team.
All takedown requests must be submitted in writing and must include the following information:
- A detailed description of the copyrighted work(s) allegedly infringed.
- The exact URL(s) of the Selnotes product(s) in question.
- A statement, under penalty of perjury, that you have a good faith belief that the use of the content is unauthorized.
- A statement confirming that the information provided is accurate and that you are the copyright owner or legally authorized to act on behalf of the copyright owner.
- Your full name, company/organization (if applicable), role or title, contact information (email, phone number), and signature (physical or digital).
- Verifiable proof of ownership, such as official registration documents, publicly accessible official sources, timestamps, publication data, or other legally admissible materials.
Please note that we do not accept generalized takedown notices. Requests must be specific and accompanied by solid, credible evidence. Selnotes reserves the right to request further clarification or documentation before taking any action.
3. Burden of Proof on Rights Holders
To maintain a fair and lawful process, the responsibility to prove ownership lies with the copyright claimant. Selnotes will not take action against a user’s product unless the rights holder provides strong and verifiable evidence demonstrating that the content in question is indeed copyrighted and has been used without authorization.
The types of proof we consider include, but are not limited to:
- Copyright registration certificates or documents from copyright offices.
- Original files or screenshots showing authorship and publication dates.
- Direct URLs linking to official content hosted by the claimant.
- Statements from the original author accompanied by legal documentation.
Unsubstantiated or weak claims will not be sufficient to justify content removal. Selnotes does not remove content based on assumptions, inferred ownership, or vague similarities.
4. Educational Content Disclaimer
As an educational marketplace, Selnotes allows the distribution of content such as study notes, summaries, flashcards, mock tests, and user-created exam preparation materials. Some of this content may resemble standardized tests or exam topics. However, Selnotes distinguishes between genuinely original, independently created study materials and unauthorized copies of official, proprietary exams.
We do not allow the upload or sale of:
- Official exam questions or full tests from institutions or publishers (e.g., ATI, Kaplan, etc.) without explicit rights or licensing.
- Documents copied from copyrighted textbooks or commercial courseware.
Content that is paraphrased, independently written, or created from personal study experience is permitted, so long as it does not violate the intellectual property of others. If you are a seller and unsure whether your material is compliant, we encourage you to contact our support team before uploading.
5. Counter-Notice and User Rights
If you are a Selnotes user and believe that your product was removed in error or due to a mistaken copyright claim, you have the right to submit a counter-notice. This enables you to explain your position and request reinstatement of the content.
A valid counter-notice must include:
- The URL of the content that was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your full name, email address, and a digital or physical signature.
- A statement that you consent to the jurisdiction of the court in your country or region and will accept service of process from the original claimant.
If the original rights holder does not initiate legal action within a reasonable period (typically 10–14 business days), we may reinstate the disputed content at our discretion.
6. Repeat Infringer Policy
Selnotes enforces a strict repeat infringer policy. Users who are found to have repeatedly uploaded infringing content may face escalating consequences, including:
- Formal warnings
- Temporary suspension of their seller account
- Permanent removal from the Selnotes platform
Each case is reviewed individually, and users will be given an opportunity to respond before any final action is taken. We believe in transparency and fairness while maintaining compliance with the law.
7. Identity Verification of Rights Holders
To prevent abuse or fraudulent claims, Selnotes reserves the right to verify the identity of any party submitting a takedown request. This may involve requesting:
- Use of an official email address matching a known company or publisher domain
- Legal documents proving your authority to act on behalf of the copyright owner
- Third-party authorization letters
Any takedown requests lacking sufficient identity verification may be held until further evidence is provided. Misuse of the takedown process may result in legal consequences.
8. Legal Jurisdiction and International Compliance
Selnotes operates globally and complies with multiple legal frameworks concerning copyright, including but not limited to:
- The Digital Millennium Copyright Act (DMCA) in the United States
- The EU Copyright Directive (EUCD)
- Applicable national copyright laws in Turkey, India, and other jurisdictions where we operate
By submitting a takedown or counter-notice, you agree to abide by the legal requirements and dispute resolution mechanisms of the relevant jurisdictions.
